BDMTS Terms and Use and Privacy Policy

 

Thank you for using BDMTS. This Terms of Use Agreement (“Agreement”) governs your access and use of this website, operated by BDMTS (“our,” “us,” or “we”) and located at BDMTS.com (collectively, the “Website” or the “Site”). By accessing, browsing, and using this Website, you (“you” or “User”) agree that you have read, understood, and agree to be bound by this Agreement. If you do not or cannot agree with any of the terms herein, you must cease use of the Website.

We reserve the right to change this Agreement at any time, at our sole discretion. If we make any changes, we will notify you by posting the changes here. You are responsible for reviewing any changes to the Agreement. Your continued use of the website after posting of changes to the Agreement is your acceptance to the modified Agreement. The Agreement was last modified on May 15, 2023. 

By continuing to use the Website, you state you have the power and authority and are of sufficient age to enter into this Agreement. You confirm that you are not representing or impersonating someone else and that all the information you provide to us will be accurate, true and complete to the best of your knowledge at the time of provision. The Website is not for use by users under 18 years of age. If you are under 18, do not use the Website and do not provide us with any personal information. We make no claims that the Site or any of its content is accessible, functional or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. 

We reserve the right at any time, and from time to time, to modify, suspend or discontinue (temporarily or permanently) the Website, or any part of the Website, with or without notice. 

You have access to use BDMTS.com for informational purposes. Any third party that the Website links to is not endorsed by BDMTS in any way. BDMTS has no control of content on any linked third-party site. BDMTS does not provide telecom, internet or bundling services. The information available through the Website is provided solely for informational purposes on an “as is” basis at user’s sole risk. This site is not providing financial, legal, business, technical, or other professional advice. BDMTS makes no guarantees as to the accuracy, quality, or completeness of the information and BDMTS shall not be responsible or liable for any errors, omissions, or inaccuracies in the information or for any user’s reliance on the information. BDMTS is not responsible for any discrepancy between information on the Website and similar or related information on other, third-party sites. BDMTS makes no guarantee that any quotes, fees, deals, offers or services or the service providers providing them are the best available for each user. User is solely responsible for verifying the information as being appropriate for user’s personal use, including without limitation, seeking the advice of a qualified professional regarding any specific questions a user may have. 

Service providers may pay fees to BDMTS for access to users who have expressed interest in certain products and/or services. BDMTS may also earn commissions from third-party Service providers when you sign up for their telecom, internet or bundling services through the links provided on BDMTS. We are not responsible for any arrangement or relationship you enter into with any third-party service provider and will not be liable for any fees, losses, costs, damages, or claims in connection with, arising from or related to your interaction with a service provider.

Our Privacy Policy, clearly outlines and explains the information we may collect from you, how we might share it and how we may use it in connection with the services we provide you on the Website.

The Privacy Policy is part of this Agreement and is hereby incorporated by reference. By using the Website, you consent to our Privacy Policy and the collection, use and sharing of information as discussed therein. Additionally, by using this Website, you acknowledge and agree that internet transmissions are never completely private or secure.

 

You may not rent, lease, lend, sell, redistribute, reproduce, or sublicense the Website. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Website, or any part thereof. You may not use the Website to abuse, defame, harass, threaten or post or cause to be posted any illegal content. You may not post any content (including in comments, if available) that infringes on the legal rights of any other person, party or property. You may not use the Website to transmit any sort of malware, virus, trojan horse or other type of damaging content or technology. To access the Website, you may not use a VPN, IP masking tools or any other method of digital identity obfuscation. If for some reason these restrictions are prohibited by applicable law or by an agreement we have with one of our licensors, then the activities are permitted only to the extent necessary to comply with such law or license(s). You may not exploit or interfere with the Website in any unauthorized or unlawful way whatsoever, including, but not limited to, by trespassing or burdening the network infrastructure or capacity. You agree and certify that all information provided by you to BDMTS or any third-party service provider linked to from the Site is accurate and true.

BDMTS reserves the right, at any time and at our sole discretion, to restrict or ban any user from using the Website and terminate their license under this Agreement for any violation of these restrictions.

BDMTS.com is the property of BDMTS and contains editorial content, information, images (including BDMTS logos) graphic elements and data that are subject to copyright, trademark, trade secret and other intellectual property laws. By using the Website, you agree to abide by all copyright and trademark restrictions.

You retain all intellectual property rights over any content that you upload or post (“User Content”), as allowed, to the Website. You grant BDMTS a non-exclusive, world-wide, transferable, sub-licensable, royalty-free, perpetual, irrevocable license to access, use, reproduce, electronically distribute, transmit, perform, format, display, store, archive, index and create derivative works from your User Content in any media now existing or hereinafter devised. 

You agree that you will not submit any content (including comments, where available) that falls into the following categories:

  • Spam, promotional content or advertisements for any product and/or service that is not BDMTS
  • Abusive, harassment, hate speech, discrimination, pornography, adult content, illegal, cyber-bullying
  • Defamation, libel, slander, trademark infringement, copyright infringement, deliberate misinformation or deception

At all times, we reserve the right to review, edit and/or remove all User Content, at our sole discretion, without notice. Additionally, we reserve the right to ban users, at our sole discretion, without notice or explanation.

By agreeing to these terms you acknowledge that we have the right to fully cooperate with law enforcement or any court order requesting us to disclose the identity of any user. You agree to hold harmless BDMTS and affiliated parties, agents, licensees and service providers from any claims resulting from any action taken by any of the foregoing parties during or as a result of its investigations and from any actions taken as a consequence of investigations by either the company/such parties or law enforcement authorities.

We cannot review all User Content before it is posted on the Website and cannot ensure that all objectionable material is caught and removed. We assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party. 

If you suspect that your copyrighted work has been posted or reproduced on BDMTS without proper authorization, you may contact us at support@bdmts.com. Please put “Copyright Infringement Request” in the subject line and include your name, identification and description of the infringed upon copyrighted content, your preferred contact method and information, and statement, under penalty of perjury, that the information you are providing to us is accurate and that you are authorized as or on behalf of the content owner. Any user who provides misleading or deceptive requests that result in damages, cost, expenditures or fees on behalf of BDMTS will be held liable for said damages.

You agree to indemnify, defend and hold harmless BDMTS and its officers, directors, owners, employees, agents, information providers, affiliates, licensors and licensees (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable attorneys’ fees, incurred by the Indemnified Parties in connection with any claim arising out of (a) any User Contributions, or (b) breach by you or any user of your account or these Terms of Use or any representations, warranties and covenants contained in these Terms of Use. You shall cooperate fully and reasonably in the defense of any such claim. BDMTS reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

USER ACKNOWLEDGES THAT ANY RELIANCE UPON ANY SUCH DATA, OPINION, ADVICE, STATEMENT, OR INFORMATION SHALL BE AT USER’S SOLE RISK.

SOME JURISDICTIONS DO NOT ALLOW FOR SOME OF THE LIMITATIONS OR EXCLUSIONS AS SET FORTH HEREIN. USER MAY HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.

 

These Terms of Use are governed by, construed and enforced in accordance with the laws of the State of Nevada (without regard to conflict of law principles). In the event of any dispute, you irrevocably consent to exclusive jurisdiction and venue in the courts located in the State of Nevada.

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SITE MUST BE COMMENCED WITHIN SIX (6) MONTHS AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED AND YOU HEREBY AGREE TO WAIVE SUCH CAUSE OF ACTION OR CLAIM AFTER SUCH DATE.

 

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

No waiver by BDMTS of any terms in this agreement shall deem any other term or condition invalid or unenforceable. Nor shall any failure to enforce any part of this agreement by BDMTS constitute a waiver of such term(s) or any other.

 

Neither Party shall liable hereunder for any failure or delay in the performance of its obligations under this Agreement if such failure or delay is on account of causes beyond its control, including labor disputes, civil commotion, war, fires, floods, inclement weather, governmental regulations or controls, casualty, government authority, strikes, or acts of God, in which event the non-performing party shall be excused from its obligations for the period of the delay and for a commercially reasonable time thereafter.

Entire Agreement

These Terms of Use represent the entire and only agreement between you and BDMTS with respect to the Website and supersede all prior or other understandings, agreements, representations and warranties, both written and/or oral, with respect to the Website.

Collection and Use of Consumer Information

This Privacy Policy applies only to customers that use (“Consumers”) BDMTS.com (the “Website”, or “Site”) or any website owned by BDMTS. It does not apply to websites that are websites maintained by other third parties, companies or organizations to which we link. In addition, this policy applies only to information collected by BDMTS online, not offline. At any point, BDMTS reserves the right to collect any additional Consumer information for specific business purposes. This privacy policy will be updated accordingly to reflect those changes.

Legal Protection

We reserve the right to disclose your Consumer PII, as required, to comply with the law, applicable regulations, governmental and quasi-governmental requests, judicial proceedings, court orders, or legal process, and will establish or exercise our legal rights and defend against legal claims at our discretion. In response to court orders, subpoenas and to comply with government investigations, we will share, without notice to you, all information we possess. We may also share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of BDMTS’ Terms of Use or as otherwise required by law, at our sole discretion.

Use and Sharing of Your Personally Identifiable Information

BDMTS reserves the right to sell or transfer your personal information to third parties for any purpose in its sole discretion. This includes sharing Consumer PII with BDMTS partners, sponsors, advertisers, service providers and marketers, lookup and reference services and any other entities that BDMTS believes are able to provide Consumers with special offers and opportunities. However, BDMTS prohibits the sale or transfer of Consumer PII to non-affiliated entities for their use without giving you the opportunity to opt-out. Although BDMTS advises everyone who receives Consumer PII from BDMTS to support this Privacy Policy, BDMTS has no control over such party’s information handling practices and is not responsible for any failure of such party to adhere to this Privacy Policy.

Additionally, BDMTS may share Consumer PII in aggregate, non-personal form, with select companies that wish to reach a particular Consumer target audience (e.g., male Consumers between the ages of 25-34, who have an average household income of over $30,000). This information will allow these entities to provide relevant offers to specific Consumers.

Finally, BDMTS may disclose Consumer PII in order to: (1) comply with applicable laws; (2) respond to governmental inquiries; (3) comply with valid legal processes; or (4) protect the rights, property and other Consumers of BDMTS.

By registering and using this Website, Consumers acknowledge that the processing of their Consumer PII for the purposes described above may involve the transfer of such PII from within the United States of America (“USA”) to countries outside the USA whose data protection regulation may not be as stringent as that within the USA.

When you request quotes or services from or through BDMTS or any other website that we operate, you are authorizing us to share information with our partners who may contact you by (i) phone, including without limitation any prerecorded telephone call to any telephone number including without limitation any wireless telephone number, which could result in charges to you, (ii) SMS text message, (iii) email, or (iv) mail. We may also contact you through any of the above means. If you do not want further communication from them or us, please notify the person or entity that contacts you directly. We reserve the right to make changes in this policy at any time.

Business Transfer

It is possible that, in the future, BDMTS could merge with or be acquired by another company. If such an acquisition occurs, the successor company will have access to the information maintained by BDMTS, including customer account information. In any event, whether acquisition or merger, this Privacy Policy will remain in effect.

Minors

You must be at least 18 years old to use this website. We do not knowingly collect, use, or disclose personal information about visitors under 18 years of age. If you are under 18 years of age, you may not use the services offered on our website unless they are used with the consent, permission and supervision of your parents or guardians.

To tailor and improve our Consumer experience, we may use different technologies, including but not limited to those bulleted below, to collect information other than what we may receive directly from you.

If we ask you for personal information, we will provide you the opportunity to “opt-out” of having your personally identifiable information used for certain purposes. You may continue to receive email communications from us for up to ten (10) business days from the time we receive your unsubscribe request. Please note that BDMTS can only control its own mailing list and policies. Third party advertisers with whom we may share your information and that maintain their own mailing lists may send communications that advertise our services or their own, and you may need to contact these parties directly in order to stop receiving their communications. Although BDMTS only supports permission-based emails, BDMTS does not obligate itself to restrict third parties advertising BDMTS beyond that which is required by applicable law.

You may also use the Network Advertising Initiative (“NAI”) and Digital Advertising Alliance (“DAA”) opt-out tools to learn more about targeted or interest based advertising and to opt out of certain targeting programs not associated with BDMTS.

Advertisements & Pop Up Windows

On occasion, you may receive advertisements for BDMTS, our websites, or our services from third parties. These advertisements are served by the third-party website that you have visited or directly from the Website or any website owned by BDMTS. In addition, such advertisements may be placed by third party ad servers or ad networks. We may use a number of third-party ad networks to advertise. Your relationships, transactions and any opt-out requests with any such third party are governed by their policies and not those of BDMTS.

Third Party Links

This Privacy Policy applies to all information that you provide to BDMTS. Personal Information Report Request

In accordance with the California Consumer Privacy Act (CCPA) and other applicable state and federal regulations, you may request a report of personal information collected about you by BDMTS within the past twelve (12) months, the categories of sources from which such personal information was collected, the purpose of such collection and the categories of third parties with whom your personal information was shared. This complimentary report may be requested twice in a twelve-month period and will be provided within forty-five (45) calendar days from the request submission date upon verification of your identity. A request authentication measure is in place to ensure that your personal information is not being distributed to the wrong parties. Failure to comply with all necessary steps will result in an incomplete request and your consumer information report will not be sent. You may opt to receive your report electronically or by postal mail. To request your report, email us at support@bdmts.com and put “PII Information Report Request” in the subject line. Include in your email your full name, your phone number, your email address and postal address. We will follow up to confirm your identity and provide your report.

Personal Information Removal/Deletion

Once you have emailed us the information requested above and we have confirmed your identity, upon your direction, we will remove and delete all of your personal information that we have stored.
